Booking Terms

Arrival & Departure Times: Rentals commence at 4.00pm on the first day of the rental and end at 10.00am on the day of departure unless otherwise notified. This period is hereafter referred to as the “Holiday” The period booked will be stated on the reservation confirmation provided to the Guest when they book and cannot be exceeded unless by prior approval. The Guest will be liable for any cost, of whatever nature, incurred because of an unauthorised extension.

Deposit: 30% deposit is required on confirmation of booking. Once payment is received this then becomes a “Booking”. If a Booking is made less than six weeks before the start of the Holiday, the full amount plus any additional charges must be paid at the time of booking. 

Final Payment: Unless otherwise in writing, the price for the Holiday shall be the rent for the property as set out on the Website at the time of the booking and detailed within confirmation emails / letters. Subject to a cancellation, as soon as the booking is confirmed, the Guest is liable for payment of the balance of the rent. The balance is payable six weeks before the start of the Holiday (the “Due Date”) and non-payment by the Due Date may be treated as a cancellation. The Due Date will be set out on your Reservation Confirmation, Balance Payment reminder emails will be sent  seven days before and on the day the payment is due. If payment is not received by the Due Date, then the Guest will lose their booking and the deposit will be forfeited. 

Method of Payment: Payments must be made by electronic bank transfer and details will be provided upon confirmation of the booking.

Booking Fee: A non-refundable booking fee of £30 is payable on all bookings at the time of Deposit Payment or Full Balance payment for ‘last minute’ bookings.

Overseas Bookings: Overseas Guests may pay in Sterling by international electronic transfer.  SWIFT and IBAN numbers will be provided on request. Any charges for payments from overseas will be passed on to the Guest via a deduction from the security deposit. 

Security Deposit: A security deposit is due for payment with the Final Payment towards the Holiday, this is £200. The whole amount of the Security Deposit, or the balance after any deduction will be refunded to you within 7 days following the end of the Holiday by direct bank transfer. The Owner shall be entitled to deduct from the Security Deposit the cost of remedying any breach of Guest’s Obligations. Please note that damages and losses are not limited to the security deposit and any costs in excess of this amount will be invoiced and payable in full without delay.

Condition of Property: Please ensure that you follow the instructions in the welcome manual of the property on your departure. A Housekeeper reports  to the owner when the property has been vacated and any losses, damage or any cleaning necessary over and above normal servicing, will be deducted from your security deposit. By sending the reservation form, you authorise payment for these from your security deposit.

Linen: All bed linen and a set of towels per person, plus four hot tub towels are included with the property. A weekly clean is not included in the cost of your holiday but can be arranged at an extra cost if required.

Parking: One parking space is included at Atlantic Watch.

Keys: The property offers two sets of keys for your convenience, both of which must be left at the property upon departure, one inside and one in the key safe outside the front door. The cost of new keys will be deducted from the security deposit.  

Changing a Booking: Once the date of a booking has been accepted and payment made,  a change to the booking will be treated as a cancellation and can only be changed to another date at the owner’s discretion, providing the new date is available. Please note a £30 Transfer Administration fee will apply.

Cancellation: A booking can only be cancelled prior to the start of the Holiday. A Guest who wishes to cancel the Holiday must notify The Owner in writing (an email is acceptable) within seven days of them becoming aware that they cannot take up the Holiday, (“Cancellation Notice”). If a Cancellation Notice is received six weeks or more before the Holiday is due to start, the balance payment will be cancelled. If cancellation is made less than six weeks before the start of the holiday, the balance is payable in full. There is an administration change of £50.00 for cancellations. In the event of a cancellation, The Owner will use their best endeavours to secure another booking for the same period. If this is achieved, the applicable monies paid for the replacement booking (s), less the Booking Fee and £50.00 Cancellation charge, will be refunded. Should the property be made unavailable for any of the period covering your cancellation, a refund will be made based on the pricing model used for your booking i.e. short break or pro rata, if made unavailable ie Owner Booked during a discounted period the applicable discount will be made to the refund. If due to any occurrence beyond the control of the owner or his agent, the accommodation is unavailable as booked e.g. fire, flood etc, all monies paid will be refunded in full but there will be no further liability towards the hirer.

Eligibility: Bookings from groups of single people under the age of 25 are not accepted and all male or all female parties of more than three people are also not accepted. 

Complaints: All complaints must be notified to the Owner as soon as reasonably practicable, as an on-the-spot investigation may be required and if necessary, require the Owner to take remedial action. Should you have a complaint, you must allow the Owner the opportunity to put matters right during the Holiday. Guests have a legal obligation to mitigate their loss. If the Owner is denied the opportunity of investigating the complaint within a reasonable time or denied the opportunity to put matters right during the Holiday, then the guest will waive all rights.

Pets: Pets are not accepted at the property.

Free Broadband / WIFI: Internet connection is provided as a free service. No guarantee can be made that the service will be compatible with your device. No technical support for the connection is available. Due to the number of parties involved in providing the service, functionality of the connection cannot be guaranteed, although will where possible advise guests of any known problems prior to the stay. Should the broadband connection not be functioning for any reason please let the Owner know so that the fault can be resolved, no liability is taken by either the Owner.

SKY TV: Sky and Netflix TV are provided as a free service. The Owner is unable to provide the PIN to the Sky box. Therefore, there may be viewing restrictions applied during the day as per Ofcom regulations e.g. Watershed limitations. We apologise for any inconvenience caused.

Website Descriptions: The Owner reserves the right to amend prices quoted, due to errors or omissions. 

Personal property: Any personal effects left by guests can be forwarded to their home address at a cost of £5.00 plus postage (Subject to VAT). Unclaimed articles will be disposed of after 28 days.

The Guest’s Obligations: The Guest has the right to occupy the property for a Holiday only (within the meaning of schedule 1, Paragraph 9 of the Housing Act 1988.) The Guests agree: (a) That in no circumstances should overnight accommodation be provided for guests other than those outlined on the Reservation Form unless the Owner is notified in advance. (b) To undertake to pay for any losses or damage to the property caused (reasonable wear and tear excepted). (c) To take good care of the property and leave it in a clean and tidy condition at the end of the tenancy. (d) To permit the Owner reasonable access to the property. (e) That a cot may only be occupied by a child aged 36 months or less. (f) Not to cause an annoyance or become a nuisance to occupants of adjoining premises. (g) It is illegal to smoke in the property including vaping or leave cigarette butts anywhere on the premises. In the event of breach of these terms and conditions, the Guests may be required to leave the property during the period of the booking.

Liability: The Agent does not accept liability for any act, neglect or default on the part of the Owners or any other person not within their employ, nor for any accident, damage, loss, injury, expense or inconvenience whether to person or property, which the Guests or anyone connected with the Holiday may incur. The Owner reserves the right to cancel owing to unforeseen circumstances beyond their control. If for any reason beyond the Owners control, the property is not available on the date booked (owing to fire damage for example) or the property is unsuitable for a Holiday, all Holiday payments and additional charges paid in advance by the Guests will be refunded in full, but the Guests shall have no further claim against the Owner. The Owner shall not be held responsible for any maintenance / building works taking place outside of the rental property including Network Rail or other rail maintenance company.

Disclaimer: One Atlantic Watch is used at your own risk. The balcony, elevated terrace and hot tub is used at your own risk. Parents should ensure that their children are supervised in such areas at all times.

Governing Law & Jurisdiction: The contract is deemed to have been made at One Atlantic Watch, Porthrepta Road, Carbis Bay, St Ives, TR26 2NZ,  the validity, construction and performance of this Agreement shall be governed by English Law. The Guests submit to the exclusive jurisdiction of the English Courts.

Authority to Sign: The person who sends the reservation form certifies that he or she is authorised to agree the Terms and Conditions on behalf of all persons included on the booking form, including those substituted or included later. He or she agrees to take responsibility for the party occupying the property.

Discrepancies: In case of a discrepancy between these Booking Conditions and any other contents of the One Atlantic Watch website, these Conditions shall prevail, but this shall not limit the Owners liability for failure to supply the accommodation as described on the website. In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect.
